Terms of Service

These Terms of Service ("Terms") govern your use of the Holodek mobile application (the "App") and the holodek.app website (the "Site"), together the "Service". The Service is provided by Noldor Technologies (Registration Number 2015/336648/07), a company registered in South Africa ("Noldor", "we", "our", or "us"). By creating an account or using the Service you agree to be bound by these Terms. These Terms constitute an electronic agreement under the Electronic Communications and Transactions Act 25 of 2002 of South Africa.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18 (or the age of majority in your jurisdiction) you confirm that a parent or guardian has reviewed these Terms with you.

2. Accounts

To use multiplayer features you must create an account. You are responsible for the activity that happens under your account and for keeping your sign-in credentials secure. Tell us through our contact form, or at info@holodek.app, if you suspect your account has been compromised.

You agree not to:

• Impersonate another person or misrepresent your affiliation
• Create multiple accounts to gain an unfair advantage in matchmaking
• Share your account with someone else for the purpose of cheating or boosting

3. Acceptable use

While using the Service you agree not to:

• Use bots, scripts, modified clients, or any automated tools to play matches as a human
• Exploit bugs, race conditions, or implementation flaws to gain an unfair advantage
• Harass, abuse, threaten, or use hate speech against other players
• Upload or share unlawful, infringing, or harmful content (e.g. profile pictures)
• Reverse-engineer, decompile, or attempt to extract the App's source code, except where the applicable law expressly permits it
• Interfere with the Service's normal operation, including denial-of-service attempts

We may suspend or terminate accounts that breach these rules. For serious violations we may report conduct to law enforcement.

4. Pricing and purchases

The App is free to download and play, with no advertisements. We also offer an optional paid membership, Holodek Plus, and optional one-time purchases. The price and terms of any purchase are always shown in the App before you buy, and you are never charged without an explicit confirmation.

Holodek Plus (auto-renewable subscription)

Holodek Plus is an auto-renewable subscription that unlocks the full daily-puzzle archive, unlimited puzzles beyond the free daily set, and the other membership benefits described in the App. It is offered on a monthly plan and an annual plan, and may include a free trial period.

• The subscription price and plan length are shown in the App before purchase, in your local currency.
• Payment is charged to your Apple App Store or Google Play account when you confirm the purchase.
• If a free trial is offered, any unused portion of the trial is forfeited when you purchase the subscription.
• The subscription renews automatically for the same period at the then-current price unless you turn off auto-renewal at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the current period ends.
• You can manage the subscription or turn off auto-renewal at any time in your Apple App Store or Google Play account settings. Cancelling stops future renewals; access continues until the end of the period you have already paid for.

One-time purchases

We also offer optional one-time, non-consumable purchases, such as a lifetime Founder membership. These do not renew and are charged once, at the price shown before you buy. Members who previously purchased Premium or Founder keep their benefits, which include Holodek Plus access.

Billing, restore, and refunds

All purchases and subscriptions are processed and billed by the Apple App Store or Google Play (depending on your device), not by Noldor directly; we do not receive or store your payment-card details. Your membership applies across all current and future games we ship, and you can restore previous purchases at any time from the membership screen in the App.

Refunds are handled by Apple or Google under their respective store policies — request a refund through the store you purchased from (for Apple, reportaproblem.apple.com; for Google, your Play Store order history). Purchases and subscriptions are licensed to you under these Terms (and Apple's standard Licensed Application End User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula, where the App is obtained from the App Store) and are non-transferable.

5. Intellectual property

The Holodek name, the Holodek mark, the game designs (including Eina and Countdown), the artwork, the source code, and the brand assets are owned by Noldor Technologies or its licensors and are protected by copyright, trademark, and other intellectual-property laws.

We grant you a personal, revocable, non-exclusive, non-transferable licence to install and use the App on devices you own or control, solely for personal, non-commercial use.

Game mechanics (e.g. matching-card rules) are not protected by copyright; our specific implementation, artwork, names, and codebase are.

6. User-generated content

You retain ownership of any content you create on the Service (e.g. profile picture, display name). By uploading or submitting it, you grant us a worldwide, non-exclusive, royalty-free licence to host, display, and use that content for the purpose of operating and promoting the Service.

7. Termination

You may stop using the Service and delete your account at any time from within the app, or by contacting us through our contact form or at info@holodek.app, using the email address linked to your account.

We may suspend or terminate your access if you breach these Terms, if we are required to by law, or if we discontinue the Service. We will give reasonable notice unless prevented by an emergency or legal requirement.

8. Disclaimer of warranties

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, error-free, or perfectly secure.

9. Limitation of liability

To the maximum extent permitted by law, in no event will Noldor Technologies, its directors, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or in connection with your use of the Service. Our total aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed ZAR 1 000 (one thousand South African Rand).

Nothing in these Terms limits any liability that cannot be limited by law (for example, liability for death or personal injury caused by negligence, or for fraud).

10. Indemnity

You agree to indemnify and hold Noldor Technologies harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms, your violation of applicable law, or your infringement of any third-party right.

11. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the South African courts.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes we will notify you in the App or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
